Diane, what do you think about this Seattle judge blocking the ending of citizenship birthright? I heard it's being argued that no matter if your parents are legitimately here or not at the time of your birth, you SHOULD be an American citizen and your parents therefore would have a right to live here even if they crossed illegally. Or, does this birthright, which is constitutional, and guaranteed by the 14th amendment, should apply to illegals? It seems it should NOT apply to illegals. It should only apply to those who cross LEGALLY as well as native citizens.
The 14th Amendment was written to leave NO DOUBT that former slaves, born in America, ARE citizens. Period! The drafters and those who argued pro & con never considered it a way for non-Americans to give birth on our soil and then have an anchor baby.
Yes. It’s semi like the wording of the Second Amendment. You need to read carefully and slowly. The key is where the parents are within and under Jurisdictional control. I like to state if it is used as it has been for way too long, meaning born here, then by definition, anyone born whose parents were living in a foreign country because they were in military or State Dept, those kids would be citizens of that country and not American. Clearly that is not the case, so then why are “visitors” to US who aren’t citizens somehow giving birth here, American? While visitors have Rights, that are not legally American. They are citizens of their home country and their children are therefore citizens of their parent’s country.
