Heirs inherit the patients’ estates for themselves, free from Medicaid's grasp. Taxpayers have to pay the bills while heirs profit. As if people didn't have high enough taxes already. Sometimes children institutionalize their parents and make Medicaid pay for it, while the kids get the home(s) for themselves (without having to pay Medicaid).
I handled probates in Oregon. There, Medicaid puts a lien on the house and it MUST BE paid off before heir get $$$. I only handled a few of these, as most of my probate were higher income deceased. However, my impression was: Oregon Medicaid overcharged big time so they could milk all the equity out of the house.
It would seem that in Oregon, offspring would be far less likely to try to institutionalize their aging parents while getting them to sign papers including a Lady Byrd deed entitling such offspring to the parental estate, then. An additional shocker here in Texas involves how the Texas Bar attacks lawyers caught up in such a mess and trying to sort it out. That Bar claims representations made to the Court were either unduly candid (i.e. a violation of privacy & confidentiality) or not candid enough and therefore a misrepresentation and even a frivolous action that drove up the cost of litigation. NY spent $78 Billion on Medicaid in 2024. I know a 59 y/o woman and her 21 y/o daughter who abuse Medicaid. It angers me! I wish there was a Medicaid abuse hotline, I'd turn them in.
