Yesterday, Governor Gavin Newsom signed a bill into law that is likely to become a prototype for other blue states: henceforth, attorneys in California will be required to inform the bar if they know of any attorney who “engaged or conspired to engage in seditious conspiracy, treason, rebellion or insurrection, as defined by federal law.” Of course, this is only aimed at attorneys who don’t advance the Democrat agenda being promoted at the time.
This continues the almost nationwide efforts by Democrats to 1) Prevent Americans from questioning the fraud in the 2020 election AND all future elections; 2) Prevent Americans from finding attorneys to expose election fraud; and 3) Terrify attorneys from representing “certain” clients. This new bill falls right in line with the DOJ’s & FBI’s new category of “extremists:” Trump voters and likely Trump voters.
The bill's passage comes amid the ongoing disciplinary trial of former Trump attorney John Eastman, whom California State Bar prosecutors said should lose his law license over ethics violations he allegedly committed as he attempted to expose the fraud in the 2020 presidential election. As a retired Oregon attorney, I can assure you that giving legal advice, even if the judge eventually rejects that legal theory, was never an “ethics violation” before. THIS is just one of thousands of ways created by Democrats to “get Trump.”
Eastman, who has not been accused of seditious conspiracy, treason, rebellion or insurrection, drafted legal memos suggesting VP Mike Pence could refuse to accept electoral votes for Joe Biden from several swing states when Congress convened to certify the 2020 vote count. Such legal theories were advanced during the Bush v. Gore contested election in 2000. The 2000 attorneys were not accused of ethics violations nor charged with crimes. Such legal memos, even those advancing bizarre legal theories, are a standard part of practicing law and were never considered a subject for disciplinary actions before in California, or in any other state. Eastman has defended his actions, arguing that his legal theories were viable and advanced in good faith.
WHY YOU SHOULD CARE
Giving a client HONEST legal advice is never, can never be, “sedition, treason, rebellion or insurrection.” This is an oxymoron. It is logically impossible. Even if you are not a Trump supporter. Even if you are a Democrat. Even if you think you will never need an attorney. YOU should be concerned about this political incursion into the practice of law. One of the reasons America’s court system has worked so well for generations & generations is due to one basic premise: even the most heinous person is entitled to legal representation. Given the upside down logic that currently controls too much of our political & social discourse, YOU may find yourself to be THAT heinous person who cannot find an attorney because attorneys are terrified of losing their licenses, or worse.
