Living Behind Enemy Lines, Tale #10: Can’t Have A Christian Judge!

President Donald J. Trump was not the first target nor the first victim of Democrat lawfare.  Long before Trump’s arrival on the political stage, the Oregon legal establishment was picking and choosing, based on political and religious ideology, whom to target for persecution. This article is the tenth in my series called “Living Behind Enemy,” which describe what it is like for a Christian, Conservative or Republican living in blue jurisdictions.

The Democrat/Progressives power elite were itching to get Judge Vance D. Day off the bench the minute he was appointed by Oregon Governor John Kitzhaber in 2011.  Since Judge Day was both a Christian and the former chair of the Oregon Republican Party, yours truly was shocked that Democrat Kitzhaber appointed him to the bench.  (At that time, I was practicing law in a burb of Portland, a Blue city in a Blue state.)  Very popular in his county, Day was later elected by the citizens of Marion County for a full term.  The state capitol, Salem, is situated in Marion County and is crawling with Woke Democrats and Liberal Bullies.

Activists at the Marion County District Attorney’s Office watched Judge Day like a hawk. They were hoping to discover charges, any charge, against him to get this Christian off the bench.  They eventually drummed up a flimsy gun charge (regarding Day’s adult son’s legal ownership of a firearm) based upon the word of ONE MAN who suffered from brain damage & alcoholism.  One witness and no evidence whatsoever!

HONEST PROSECUTORS WOULD NEVER INDICT BASED UPON ONE PERSON’S WORD

Think about that for a minute.  The word of one person cannot sustain a successful prosecution, EVER. Should the jury convict under such circumstances, the case would quickly be dismissed on appeal. Evidence, the prosecutor needs evidence to back up one person’s word.  Anyone who watches TV detective shows know that.  A fair-minded prosecutor would not charge anyone without evidence, which can take the form of documents, other witnesses, surveillance tapes, various forensics, ballestics etc, etc, etc. Anyone can tell a tale.  But, for district attorneys pushing a political agenda, the punishment is in the prosecution itself, even when it ends in a non-conviction. Their goal is to persecute the target as a warning to others.

Never mind being fair-minded, they had to get this Christian off the bench as an example to other Christians to hide their faith and to leave the public square. The day after the trial began, the deputy district attorney in charge of the case asked the judge to drop all charges.  ALL CHARGES!  Their very flawed witness, their only witness against Judge Day, refused to testify. By that time, Day had already been removed from the bench, which was their main goal. Justice had nothing to do with it.

OH, WELL, NEVER MIND!

These political hacks masquerading as “public servants” did not care about the dismissal of their case.  They were not embarrassed or ashamed, because they had accomplished their mission: to get this Christian off the bench as a warning to all Oregon judges & attorneys, as well as the public. Keep your faith secret or we will target you! In their minds, they succeeded!  Judge Day is still a member in good standing with the Oregon State Bar, despite efforts to disbar him.  To this day, Vance D. Day does not have one black mark on his record.
